DISPLACED WORKER RECEIVES 108K OF SEPARATION BENEFITS THROUGH THE DOLE SENA PROGRAM

 

CALAPAN CITY, ORIENTAL MINDORO – On 16 July 2021, DOLE MIMAROPA thru its Oriental Mindoro Field Office (DOLE OrMin) settled the amount of Php108,603.00 representing separation pay and final pay in favor of a displaced worker as a Requesting Party through the conduct of Single-Entry Approach (SEnA).

 

The COVID-19 pandemic brought severe negative impacts to various private companies. This resulted to cessation of business operation and laying-off of workers. Consistent with its mandate to protect workers’ rights, the Department of Labor Employment (DOLE) provides assistance to affected workers in getting their separation pay and other monetary benefits due to them.

 

Mr. Pogz[1], a resident of Pinamalayan, Oriental Mindoro was employed in a Footwear Retail Company based in Manila wherein he was assigned in its Calapan City branch. On 31 January 2021, after serving for almost 14 years, he was notified by his employer that he will be retrenched as the Calapan branch will close due to financial difficulties incurred by the company. Despite follow-ups within the last 4 months, he failed to receive his separation benefits and final pay.

 

On 01 July 2021, Mr. Pogz learned about the SEnA Program of DOLE, thus he filed the Request for Assistance which was handled by Single Entry Assistance Desk Officer (SEADO) Kathleen I. Perez.

 

Due to the logistical challenges of facilitating the said request for assistance as well as the travel restrictions imposed by the IATF and LGUs, DOLE OrMin was able to coordinate with his employer through online and telecommunication processes.

 

After several conferences, Mr. Pogz received his separation benefits of Php97,734.00 on 16 July 2021 and final pay of Php10,869.68 on 30 July 2021 together with his certificate of employment.

 

In addition to the payments made by his employer, DOLE OrMin issued a certificate of unemployment to Mr. Pogz to qualify him for the unemployment insurance under the Social Security System (SSS) Program.

 

            “Ako po ay lubos na nagpapabatid ng nagpapasalamat sa DOLE sa walang sawang follow-ups sa aking employer hanggang sa makuha ko ang aking separation pay at final pay. Nawa’y marami pa kayong matulungan na kagaya kong nagnanais ng agarang aksyon sa mga ganitong sitwasyon. Muli, maraming salamat!” (I would like to express my gratitude to DOLE for their relentless effort through follow ups with my employer until I got my separation pay and final pay. I hope that you would continue your speedy actions in assisting other clients. Again, thank you very much!)

 

DOLE OrMin Field Office Head Roderick F. Tamacay said that DOLE is committed to act speedily in any request for assistance arising from employment issues by adopting and utilizing available mode of communications. He thanked the employer of Mr. Pogz for its prompt settlement in the interest of social justice, despite the distance and financial difficulties brought about by global pandemic. “This effort in handling SEnA thru teleconferencing is one of the new normal approaches of the department and the DOLE is committed to provide services to the public to the fullest without compromising our compliance to minimum health and safety protocols,” he said.

 

Under Department Order 107 Series of 2010, Single Entry Approach or SEnA is an administrative approach that provides a speedy, impartial, inexpensive and accessible settlement procedure of all labor issues or conflicts to prevent such from maturing into actual labor case.
